1. Acceptance of Terms
These Terms of Use (“Terms”) form a binding agreement between you and Frozen Forums. By creating an account, posting, browsing, or otherwise using the Site, you agree to these Terms. If you do not agree, do not use the Site.
2. Eligibility
You must be at least 13 years old to use the Site. Users under 18 must have a parent or guardian's permission. By using the Site you represent that you meet these requirements.
3. Accounts
Authentication is handled through our forum. You are responsible for keeping your credentials secure and for everything that happens under your account. Notify us immediately if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms.
4. User Content
4.1 Ownership
You retain ownership of the content you post (listings, photos, forum posts, profile content). By posting, you grant Frozen Forums a worldwide, non-exclusive, royalty-free license to host, display, distribute, and reasonably modify (for formatting and moderation) the content for the operation of the Site.
4.2 Standards
You agree not to post content that is:
- Unlawful, fraudulent, threatening, harassing, or defamatory.
- Hateful, discriminatory, or targeting individuals based on race, ethnicity, religion, gender, sexual orientation, disability, or similar protected characteristics.
- Sexually explicit, or harmful to minors.
- Infringing on intellectual property, trade secrets, or privacy rights.
- Spam, bulk-posted, or off-topic to the section it's in.
- Political campaigning, electioneering, or partisan advocacy.
- Misrepresenting your identity, affiliation, team, or league.
4.3 Removal
We may remove content or restrict accounts at our discretion when content violates these Terms, where required by law, or where necessary to keep the community safe. We do not pre-screen content.
5. Marketplace and Classifieds
Frozen Forums provides a venue for users to list and discover hockey-related goods, services, and opportunities. We are not a party to any transaction between users.
- One listing, one category. Cross-posting a single item across multiple categories is prohibited.
- Used and new only. No fake, counterfeit, or misrepresented goods.
- No prohibited goods. No weapons, drugs, stolen property, performance-enhancing substances, or items the sale of which is restricted by law.
- Honest descriptions. List the actual condition of the item. Resolve issues with buyers in good faith.
- No store dumps. Commercial sellers must identify as businesses and follow the rules for business listings.
6. Looking-for-Goalie / Looking-for-Player
6.1 Captain broadcasts
The $5 LFG broadcast pays for distribution of your request to the opted-in Goalie Pool. It does not guarantee a goalie. The fee is non-refundable once the broadcast is sent.
6.2 Claims
Claims are first-click-wins. Once a goalie or player claims a request, no other claims are accepted. Captains and claimants are expected to honor the commitment.
6.3 Goalie Pool conduct
Goalies who join the pool agree to receive notifications per their preferences. Repeated unresponsiveness, no-shows after claiming, or false claims may result in reduced reputation, removal from the pool, or suspension.
7. Payments
Payments are processed by a PCI-compliant third party (Stripe). By paying, you authorize the charge described at checkout. Charges may include the LFG broadcast fee, Classifieds promotion fees, and any other paid features offered on the Site.
Refunds. Unless required by law, paid services are non-refundable once the service is rendered (broadcast sent, promotion live, listing featured).
8. Prohibited Conduct
You agree not to:
- Use the Site to violate any law or regulation.
- Scrape, mass-download, or systematically harvest content from the Site without written permission.
- Probe, scan, or test the vulnerability of the Site or attempt to bypass security or access controls.
- Interfere with the Site's operation, including via bots, automation, denial-of-service, or load-amplification attempts.
- Misrepresent yourself, impersonate another person, or use another user's account.
- Use the Site to send unsolicited promotional messages.
- Reverse-engineer, decompile, or disassemble any part of the Site.
9. Intellectual Property
The Frozen Forums name, logo, design, code, and original content are the property of the operator and protected by United States and international intellectual-property laws. You may not use our trademarks without prior written permission.
10. Reporting Abuse and DMCA
If you believe content on the Site infringes your copyright or otherwise violates the law, email legal@frozenforums.com with: (a) identification of the work, (b) the URL of the content, (c) your contact information, (d) a good-faith statement that the use is not authorized, and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act.
11. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT ENDORSE OR GUARANTEE ANY USER OR ANY USER CONTENT, INCLUDING LISTINGS, BROADCASTS, CLAIMS, OR PROFILES.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FROZEN FORUMS AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).
13. Indemnification
You agree to indemnify and hold harmless Frozen Forums, its operators, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of (a) your use of the Site, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any third-party right.
14. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that violates these Terms or that we determine to be harmful to other users, the operator, or third parties. You may close your account at any time by contacting support.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Franklin County, Ohio. You consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms. Material changes will be announced on the Site at least 14 days before they take effect. Continued use of the Site after the effective date constitutes acceptance.
17. Entire Agreement; Severability
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Frozen Forums regarding the Site. If any provision is held invalid, the remaining provisions will remain in full force and effect.
